1. About us
Listen-In is a local, volunteer-run community project run by the Listen-In team (“we”, “us”, “our”). It is not a registered charity, company or other incorporated organisation. You can contact us at info@listen-in.org
Listen-In collects donated second-hand iPads, prepares them with audiobooks, and lends them free of charge to North London residents. The iPads remain ours at all times. We visit borrowers from time to time to update the iPads with new audiobooks and other content. We do not sell anything, buy anything, accept money, or charge for any of our services.
2. Accepting these terms
By using this website, donating a device, or borrowing a device from us, you agree to these Terms of Use. If you do not agree, please do not use the website or take part in the project.
If you are under 18, a parent or guardian must read and agree to these terms on your behalf before you donate or borrow a device.
3. Using our website
You may use this website for personal, non-commercial purposes. You must not misuse it. For example, you must not try to gain unauthorised access, introduce viruses or harmful code, or use it for any unlawful purpose.
We try to keep the information on this website accurate and up to date. However, we cannot guarantee that it is complete, accurate or always available. We may change or suspend the website at any time without notice.
4. Donating a device
4.1 Ownership
By donating a device, you confirm that you are its legal owner or have the owner’s permission to donate it. You also confirm that it is not stolen, subject to finance, or reported lost.
4.2 Transfer of ownership
When we receive your device, you give it as an unconditional gift to Listen-In, which will use it only for the purposes of the project. We cannot return donated devices, and you will receive no payment or other benefit in exchange.
4.3 Removing your data and accounts
Before donating, please:
- back up anything you want to keep;
- sign out of iCloud and turn off Find My iPad / Activation Lock;
- erase all content and settings (factory reset).
We will factory reset every device we receive. However, we are not responsible for any personal data, files or accounts left on a device. We will not access, copy or keep any such data, except as needed to erase it.
4.4 Devices we cannot use
If a device is locked, damaged or otherwise unsuitable, we may recycle it responsibly, pass it to another community or charitable organisation, or dispose of it lawfully. We are not obliged to tell you what happens to an individual device.
4.5 Getting the device to us
You are responsible for any costs and risks of getting the device to us, unless we have agreed otherwise.
4.6 Accepting donations
We may decline any donation, for example if we already have enough devices or a device is too old to run the software needed for the audiobooks. Please check with us before sending or dropping off a device.
5. Borrowing a device
5.1 Who can borrow a device
Devices are lent free of charge to residents of North London at our discretion. We may decide who borrows a device and may decline any request. We have a limited number of iPads, and we rely entirely on donations. If all our devices are already on loan, we will not be able to provide the service until one becomes available. We may keep a waiting list, but we cannot promise when, or whether, a device will become available.
5.2 Condition
Donated devices are second-hand and are lent “as is”. We check and prepare them as best we can as volunteers. However, we cannot guarantee their condition, battery life or performance, or how long they will keep working.
5.3 Audiobook content
The audiobooks on each device are for the borrower’s personal, non-commercial listening only. Borrowers must not copy, distribute, sell or share the audiobook content, except as permitted by law.
5.4 Safe use
Please use devices and chargers sensibly and follow standard safety guidance. For example, do not use a damaged charger or a device with a swollen or damaged battery.
If you notice any problem with a device or charger, such as swelling, overheating, a burning smell, smoke, cracks or unusual noises, please stop using it immediately and unplug it if it is safe to do so. Do not try to open, repair, press on or puncture the device. Please contact us straight away so we can arrange for it to be returned.
iPads contain lithium-ion batteries, which can catch fire if damaged. Never put a device, charger or battery in your household bin or recycling bin. Because our devices are on loan, please return any faulty device or charger to us and we will make sure it is disposed of safely. If you cannot return it safely, take it to your local household waste recycling centre or an electrical retailer’s take-back point. You can find your nearest drop-off point at recycleyourelectricals.org.uk. You are also welcome to contact us for advice. If a device is smoking or on fire, move away from it and call 999.
5.5 Ownership, care and return
All devices, chargers and accessories remain the property of the Listen-In team and are lent to you for your personal use only. You must not sell, give away, lend or pawn them, or let anyone outside your household use them. Please take reasonable care of the device and tell us straight away if it is lost, stolen or damaged. We will not ask you to pay for normal wear and tear. You must return the device and its charger when you no longer need it, or if we ask for it back. We are volunteers and cannot promise ongoing technical support, repairs or replacements, although we will try to help where we can. Please do not reset the device or remove the audiobooks.
5.6 Internet, apps and accounts
If a device is connected to the internet, you are responsible for how it is used, including any apps, websites, accounts or purchases. We are not responsible for third-party apps, services or content. If a device will be used by a child, a parent or guardian should set up suitable parental controls.
5.7 Returning a device
When you return a device, please remove any personal information you have added to it. We will reset devices before lending them to someone else, and we are not responsible for anything left on a returned device.
5.8 Updates and visits
From time to time, we will contact you to arrange a visit so we can update your iPad with new audiobooks, options or settings, check that it is working properly, and carry out any maintenance. We will always arrange visits in advance at a time that suits both you and our Listen-In volunteers. Please make the device and its charger available when we visit. The audiobooks and other content on the device may change after an update. During a visit, we will only work on the device itself and will not look at any personal information you have added to it. If you would rather not have a visit, please let us know and we can agree another way to update the device, or arrange for you to return it.
6. Intellectual property
The content of this website, including text, logos and images, belongs to Listen-In. You may view and print pages for personal use, but you may not reproduce them or use them commercially without our written permission.
7. Links to other websites
Our website may link to other websites. We are not responsible for their content, availability or privacy practices.
8. Privacy
You may give us personal information, for example when arranging a donation or requesting a device. Listen-In handles it in line with our Privacy Policy and UK data protection law, including the UK GDPR.
9. Our liability
Listen-In is a free, volunteer-run project, and devices are second-hand and lent free of charge. To the fullest extent permitted by law, neither Listen-In nor any of its volunteers is liable for any loss or damage arising from use of this website, donated devices, or audiobook content. This includes loss of data, loss of use, or indirect loss.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under the law of England and Wales.
We do not guarantee that we will be able to collect, prepare or provide a device within any particular time, or at all. This includes times when all our devices are already on loan or we have no iPads left to lend.
10. Changes to these terms
We may update these terms from time to time. The latest version will always be on this page, with the date it was last updated.
11. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
12. General
If any part of these terms is found to be invalid or unenforceable, the rest will remain in effect. If we do not enforce any part of these terms straight away, we can still enforce it later. Only you and we have rights under these terms, and no one else may enforce them.
13. Contact
If you have any questions about these terms, contact us at info@listen-in.org
